Remote and hybrid work is now a standard operating mode for many small businesses — but many of the businesses that adopted it in 2020 and 2021 are still operating without a formal policy. This creates real problems: inconsistent expectations, compliance exposure in multiple states, and inequity between employees who negotiate flexibility informally and those who don't know to ask.
A remote work policy doesn't have to be long. It has to be clear.
Eligibility. Which roles are eligible for remote or hybrid work? Are there performance requirements? Is remote work a privilege or a default for certain positions?
Work location expectations. Can employees work from anywhere? Are there restrictions on working from other states or countries? (Working from another state creates payroll tax and employment law obligations that most businesses are not prepared for.)
Availability and communication norms. What are the expected hours of availability? How quickly should employees respond to messages? What communication channels are used for what purposes?
Equipment and expense reimbursement. Who provides equipment? Who pays for internet? California and a handful of other states require reimbursement of remote work expenses — make sure your policy addresses this.
Security requirements. What are the requirements for network security, data handling, and use of personal devices?
In-person expectations. How often, if ever, are remote employees expected to come to an office or attend in-person meetings?
Every state where your remote employees work is a state whose employment laws apply to your business. If you have employees in five states, you have compliance obligations in five states. Your remote work policy needs to reflect this reality — either by defining where employees may work or by building processes to manage multi-state compliance.
The most common remote work policy problem is not what is in it — it is that it doesn't exist. If your remote work arrangement is based entirely on informal agreements and manager discretion, a policy is overdue.
